DMCA Policy

Latina Vittoria Giovedì ("we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), the text of which can be found on the U.S. Copyright Office website at http://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Latina Vittoria Giovedì website and/or services (the "Site") if such claims are reported to our Designated Copyright Agent identified below.

This policy outlines the procedure for filing copyright infringement notifications and counter-notifications with us. It is our policy to remove any content that infringes the copyright rights of others upon receipt of a valid DMCA notice and, in appropriate circumstances, to terminate the accounts of repeat infringers.

Filing a Copyright Infringement Notice

If you are a copyright owner or an agent thereof and believe that any content hosted on the Latina Vittoria Giovedì Site infringes your copyrights, you may submit a notification pursuant to the DMCA by providing our Designated Copyright Agent with the following information in writing (see 17 U.S.C. § 512(c)(3) for further detail):

  1. An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright's interest.
  2. A description of the copyrighted work that you claim has been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works.
  3. A description of where the material that you claim is infringing is located on the Site, sufficient for us to locate the material (e.g., URL of the specific page or content).
  4. Your contact information, including your name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
  6. A statement by you, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Filing a Counter-Notification

If you believe that your content, which was removed or disabled, is not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the content, you may send a counter-notification containing the following information to our Designated Copyright Agent:

  • Your physical or electronic signature.
  • Identification of the content that has been removed or to which access has been disabled and the location at which the content appeared before it was removed or disabled.
  • A statement under penalty of perjury that you have a good faith belief that the content was removed or disabled as a result of mistake or a misidentification of the content.
  • Your name, address, and telephone number.
  • A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or if your address is outside of the United States, for any judicial district in which Latina Vittoria Giovedì may be found, and that you will accept service of process from the person who provided the original notification of the alleged infringement.

Upon receipt of a valid counter-notification, we will forward it to the party who submitted the original DMCA notification. The original notifying party will then have 10 to 14 business days to file an action seeking a court order to restrain the subscriber from engaging in infringing activity relating to the material on our system. Unless the copyright owner files such an action, we may, at our sole discretion, restore the removed material.

We reserve the right to remove any content without prior notice, at our sole discretion.
